These Terms & Conditions (“Terms”) govern the use and booking of the podcast studio operated by Smart Magic Productions (“Company”, “We”, “Us”). By booking or using our studio, you (“Client”, “You”) agree to these Terms.
1.1. All studio bookings are confirmed only upon receipt of full payment or a pre-agreed deposit/payment schedule.
2.1. The studio shall be used strictly for lawful recording purposes, including podcast, audio, or video content creation.
2.2. The Client shall not use the studio for any activity prohibited by law or for any content that is defamatory, obscene, or unlawful.
2.3. Late arrival shall not entitle the Client to an extension of the booking time.
3.1. The Client shall use the equipment and property with due care.
3.2. Any damage, loss, or malfunction caused due to negligence or misuse shall be chargeable to the Client at actual repair or replacement cost.
3.3. The Company is not responsible for loss or theft of any personal belongings.
4.1. The Client and all accompanying persons shall follow all safety and facility rules.
4.2. Smoking, alcohol, narcotics, and hazardous items are strictly prohibited on the premises.
4.3. The Company reserves the right to remove or deny entry to any person whose behavior is unsafe, disruptive, or inappropriate.
5.1. Any extension beyond the booked slot is subject to availability and will be charged at the applicable hourly rate.
5.2. The Company is not obligated to extend the session if the studio is unavailable.
6.1. All content recorded by the Client remains the Client’s property.
6.2. The Company does not access, edit, or store recorded content unless specifically requested by the Client.
6.3. Upon completion of the session, all recorded data will be transferred to a hard drive or storage device provided by the Client. The Client is responsible for bringing a functional storage device with sufficient capacity.
6.4. Once the data transfer is completed, the Company shall not be liable for the safety, loss, corruption, or future accessibility of the data. The responsibility for securely storing and backing up the files lies solely with the Client.
7.1. The Company ensures all equipment and facilities are maintained to high standards; however, minor technical issues or unforeseen interruptions may occasionally occur.
7.2. In the unlikely event of any service-related concern, the Company will make every reasonable effort to support the Client and ensure a satisfactory resolution.
8.1. The Client agrees to indemnify and hold the Company harmless against any claims, damages, or losses arising from misuse of the studio, breach of these Terms, or content produced by the Client.
9.1. These Terms shall be governed by the laws of India.
9.2. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra
By booking, accessing, or using the studio, the Client confirms their acceptance of these Terms & Conditions, which are intended to facilitate a safe, professional, and efficient studio experience. The Company may revise these Terms periodically to reflect operational updates or regulatory requirements. Clients are encouraged to review the Terms from time to time to remain informed of any amendments that support the continued quality and integrity of our services.
